Terms of service

Agreement

These Terms of Service (“Terms”) are a contract between you and Beakle Products LLC, the legal entity that owns and operates Dial Dragon. By creating an account, connecting a store, or using the Service, you agree to these Terms and our Acceptable Use policy.

The Service

Dial Dragon provides software that helps merchants run AI-assisted phone outreach and related SMS follow-up for ecommerce. Features may change; we will use reasonable efforts to avoid breaking core workflows without notice.

Accounts and access

• You must provide accurate account information and keep credentials secure.
• You are responsible for activity under your workspace and for users you authorize.
• We may suspend access for violations, risk to the platform, or non-payment.

Merchant responsibilities

• Obtain and document any consent or lawful basis required before calling or texting customers.
• Configure AI disclosure, calling windows, offers, and scripts appropriate for your market.
• Honor opt-outs and do-not-call requests; comply with telemarketing and messaging laws.
• Ensure store profile and offer claims are accurate.

SMS terms

• Dial Dragon updates for business owners: if you checked the calls and texts box on dialdragon.com/contact, Dial Dragon may call and text you about your inquiry and about Dial Dragon's services, including marketing. Calls may use an AI or prerecorded voice. Consent is not a condition of purchase.
• Store follow-up texts: Dial Dragon post-call texts, sent on behalf of the online store you shopped with. Messages contain the checkout link, discount code, product link, or order tracking information discussed on a call.
• Opt-in: you receive store texts only if you checked the SMS consent box at the store's checkout (or otherwise gave the store SMS consent). You receive Dial Dragon texts only if you checked the unchecked calls and texts box on dialdragon.com/contact.
• Message frequency varies. Msg & data rates may apply.
• Reply STOP to cancel at any time; you'll get one confirmation and no further texts. Reply START to resubscribe.
• Reply HELP for help, or email support@dialdragon.com. To stop calls from Dial Dragon, say so on the call or email scott@dialdragon.com.
• We never share mobile numbers or text opt-in data with third parties or affiliates for their marketing.
• Carriers are not liable for delayed or undelivered messages.

Fees and payment

Usage fees are described on our pricing page and in the app. Connected-minute billing and included SMS follow-up apply as stated there. Phone numbers and payment methods may incur separate charges shown in product. Taxes may apply. You authorize us and our payment provider to charge your payment method.

AI-generated content

Calls and messages may be generated or assisted by AI models through our providers. Output can be inaccurate. You review campaigns before launch and remain responsible for what is said on your behalf.

Data and privacy

Our Privacy policy describes how we handle data. You grant Dial Dragon the rights needed to host, process, and transmit merchant and customer data to operate the Service.

Intellectual property

Dial Dragon owns the Service, branding, and underlying technology. You retain rights to your store content. You grant us a license to use your marks and content only as needed to provide the Service.

Disclaimer

THE SERVICE IS PROVIDED “AS IS.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIAL DRAGON WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID DIAL DRAGON IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Indemnity

You will defend and indemnify Dial Dragon against claims arising from your use of the Service, your outreach, or your violation of these Terms or law.

Termination

Either party may end the relationship by closing the account or ceasing use. Provisions that by nature should survive will survive termination.

Governing law

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. Courts in Delaware have exclusive jurisdiction, subject to mandatory consumer protections where applicable.
